Terms of Service

These Terms of Service govern access to and use of CallbackPilot. By ordering, activating or using the service on behalf of a business, you confirm that you have authority to bind that business to these terms.

1. Provider and business use

CallbackPilot is supplied by P&EWEALTH LTD trading as CallbackPilot. P&EWEALTH LTD is registered in Scotland under company number SC770238, with its registered office at Squirrel Barn, Coultra Steadings, Newport On Tay, DD6 8SE, United Kingdom.

The service is intended only for UK businesses acting in the course of business. It is not offered for personal consumer use.

2. The service

CallbackPilot provides a UK local telephone number, automatic missed-call text-back, a two-way SMS inbox, a missed-call lead pipeline and team notifications. Features may be delivered through integrated third-party telecommunications and software providers.

You keep your existing business telephone number. You are responsible for correctly configuring your existing provider or telephone system to forward unanswered calls to the CallbackPilot number and for ensuring that you are authorised to control and forward that number.

3. Regulatory approval and the 14-day trial

UK number activation may require identity, address, business or regulatory checks. You must provide accurate and complete onboarding and KYC information and respond promptly to verification requests.

The 14-day free trial begins only when the CallbackPilot telephone service is activated. Time spent waiting for regulatory approval does not count towards the trial.

Activation is subject to regulatory and provider approval. We cannot guarantee that an application will be approved or that a particular number will remain available while checks are pending.

4. Price, included usage and payment

After the 14-day trial, the subscription is £79 per month and automatically renews monthly until cancelled. There is no setup fee.

The plan includes up to 100 automatic missed-call text-backs per month. Additional call, SMS or other communication usage may be charged separately at the rates notified in the service or applicable order information.

Prices exclude VAT where VAT is legally applicable. You must maintain a valid payment method and authorise us and our payment provider to take subscription, usage, tax and other properly due charges.

If payment fails, we may retry payment, restrict features, suspend service or terminate the account after reasonable notice, subject to applicable law.

5. Cancellation

You may cancel online through the account controls made available to you, or by emailing [email protected], before the next renewal date.

Cancellation stops future renewal but does not normally create a refund or credit for a partial month or unused included usage, except where required by law. You remain responsible for charges incurred before cancellation takes effect.

6. Customer responsibilities

You must:

  • Provide accurate onboarding, account, billing and KYC information and keep it current.
  • Maintain a valid payment method.
  • Be authorised to control the existing business number and configure unanswered-call forwarding.
  • Protect account credentials and manage staff access appropriately.
  • Provide appropriate privacy information to callers, contacts and staff.
  • Use the service lawfully and comply with UK GDPR, PECR, telecommunications rules and all other applicable requirements.
  • Remain responsible for your communications, message content, replies, records and business decisions.

7. Acceptable use

You must not use the service for spam or unsolicited unlawful messaging, harassment, threats, fraud, impersonation, deception, infringement, malware, harmful or abusive content, illegal activity, or any activity that interferes with networks, providers or other users.

CallbackPilot is not an emergency-service system and must not be used to contact, replace or route calls intended for emergency services. You must not suggest that the service is suitable for emergency or life-safety communications.

8. Availability and third-party services

The service depends on third-party telecommunications carriers, messaging networks, payment processors, hosting and software providers. Delivery times, number availability, carrier filtering, internet connectivity and provider uptime are outside our complete control. Uninterrupted or error-free delivery cannot be guaranteed.

We do not guarantee that every caller will receive or reply to a message, become a customer, book work or generate revenue. You are responsible for deciding when and how to follow up with callers.

9. Suspension and termination

We may suspend or restrict service where reasonably necessary to protect security, prevent fraud or unlawful use, comply with a provider or legal requirement, address failed payments, or investigate a material breach. Where practicable, we will give notice and an opportunity to remedy the issue.

Either party may terminate for a material breach that is not remedied within a reasonable period after notice, or immediately where the breach cannot be remedied, continued service would be unlawful, or an essential third-party service is withdrawn. On termination, access may cease and outstanding amounts become due.

10. Intellectual property

CallbackPilot and its licensors retain all intellectual-property rights in the service, software, branding, designs, documentation and underlying technology. We grant you a limited, non-exclusive, non-transferable right to use the service for your internal business purposes during an active subscription.

You retain ownership of content and data you lawfully provide. You grant us the rights reasonably necessary to host, transmit, process and display that material to provide and secure the service.

11. Confidentiality

Each party must protect the other's non-public business, technical and commercial information using reasonable care and use it only for the service relationship. This does not apply to information that is public without breach, already lawfully known, independently developed, lawfully obtained from another source, or required to be disclosed by law.

12. Data protection

Each party must comply with applicable data-protection law. For customer-account and caller data that we process on your behalf, you are normally the controller and we act as processor. We will process that data to provide and secure the service, follow lawful documented instructions and use appropriate safeguards with relevant subprocessors.

Controller and processor commitments are set out in the Data Processing Addendum.

13. Changes to the service or terms

We may update features, providers, technical requirements and these terms to improve or secure the service, comply with law, reflect provider changes or support operational needs. We will give reasonable notice of material changes where practicable. If a material change substantially disadvantages you, you may cancel before it takes effect.

14. Liability

Nothing in these terms excludes or limits liability that cannot legally be excluded or limited, including liability for fraud or fraudulent misrepresentation, or death or personal injury caused by negligence.

Subject to the paragraph above, neither party is liable for indirect or consequential loss, loss of profit, revenue, business, opportunity, anticipated savings, goodwill or data, except to the extent such liability cannot lawfully be excluded.

Subject to liabilities that cannot legally be excluded, CallbackPilot's total aggregate liability arising out of or in connection with the service and these terms is limited to the subscription fees paid by the customer during the 12 months immediately preceding the event giving rise to the claim.

15. Force majeure

Neither party is liable for delay or failure caused by events beyond its reasonable control, including telecommunications or internet failures, carrier actions, utility outages, cyber incidents not caused by a failure to use reasonable care, industrial disputes, natural disasters, epidemics, war, civil disturbance, government action or changes in law. Payment obligations for services already supplied are not excused.

16. Governing law and jurisdiction

These terms and any non-contractual obligations arising from them are governed by the law of Scotland. The courts of Scotland have exclusive jurisdiction, subject to any mandatory rule that legally requires otherwise.
